These Terms and Conditions govern your use of websites, pages, masterclasses, forms, scheduling tools, digital resources, products, services, communities, and educational programs operated by Walter White Music and Foundation First Brass Academy.
In these Terms, “we,” “us,” and “our” refer to Walter White Music and Foundation First Brass Academy. “You” and “your” refer to the visitor, registrant, applicant, purchaser, member, or participant using our websites or services.
By accessing our websites, submitting a form, scheduling a session, purchasing a product or service, or participating in a program, you agree to these Terms and our Privacy Policy.
Our websites, masterclasses, methods, resources, coaching, community discussions, and programs are offered for educational and informational purposes.
We do not guarantee any particular musical, professional, financial, physical, or performance result. Progress varies according to factors including experience, health, practice habits, participation, consistency, and individual circumstances.
Nothing provided through our websites or programs is medical advice or a substitute for evaluation or treatment by a qualified healthcare professional. Stop any exercise that causes pain, dizziness, injury, or unusual physical distress and seek appropriate professional guidance.
You agree to provide complete, accurate, and current information when registering, applying, scheduling, purchasing, or creating an account.
You must be at least 18 years old to purchase a program or enter into a paid agreement unless a parent or legal guardian completes or approves the transaction on your behalf.
Participants under 18 may be required to have a parent or legal guardian present during strategy sessions, enrollment conversations, or other activities.
A Foundation First Strategy Session is a complimentary conversation intended to discuss your playing, goals, challenges, and possible next steps. It is not a private playing lesson and does not guarantee admission to Foundation First Brass Academy.
Please schedule only if you intend to attend. If something unexpected prevents you from attending, contact us as soon as reasonably possible.
We reserve the right to decline, cancel, or reschedule a session when appropriate.
Submitting an application or participating in a strategy session does not guarantee acceptance into Foundation First Brass Academy.
Enrollment may require a separate written enrollment agreement, payment authorization, or program-specific terms. When program-specific terms conflict with these general Terms, the program-specific written agreement will control.
Prices, payment schedules, included services, and applicable fees will be disclosed before purchase.
You agree to provide valid payment information and authorize charges according to the payment plan you select. When a payment fails or becomes overdue, access to paid materials, coaching, or community services may be paused until the account is brought current.
Payments may be processed by independent third-party payment providers. Their own terms and privacy policies may apply.
Refund and cancellation terms may differ by product, service, event, membership, or educational program. The applicable policy will be disclosed on the purchase page, checkout page, enrollment agreement, or other written offer terms.
Unless a specific written refund policy says otherwise, purchases are not automatically refundable simply because a participant changes their mind, does not attend, or does not fully use the purchased service.
Nothing in these Terms limits any cancellation or refund right that cannot legally be waived. Michigan generally does not provide an unrestricted right to cancel every purchase, although particular transactions can be subject to special cancellation rights.
For any recurring subscription or membership offered in the future, the price, billing frequency, renewal terms, and cancellation method will be disclosed before enrollment. Subscription and cancellation terms should remain clear and easy to understand.
Unless otherwise stated, all website content and program materials—including text, videos, audio recordings, accompaniment tracks, exercises, methods, graphics, logos, downloads, course materials, presentations, and written resources—are owned by or licensed to Walter White Music and Foundation First Brass Academy and are protected by applicable intellectual-property laws.
We grant you a limited, personal, non-exclusive, non-transferable license to access purchased or freely provided materials for your own individual educational use.
You may not, without prior written permission:
Copy or distribute materials to others
Share account credentials or member-only access
Upload materials to another website, platform, or file-sharing service
Sell, sublicense, republish, or commercially exploit materials
Remove copyright, trademark, or ownership notices
Record or distribute private sessions, live calls, or community content
Create substantially derivative teaching products from protected materials
You retain ownership of original material you submit to us.
Submitting a question, application, message, recording, testimonial, photograph, video, or other material does not automatically give us unrestricted commercial ownership of it.
We will seek appropriate permission before publicly using an identifiable testimonial, image, recording, or participant story for promotional purposes, except where permission has already been clearly provided through a separate release or agreement.
You may not submit material that you do not own or have permission to share.
Some programs may include access to an online community, group, live call, or collaborative space.
Participants agree to:
Treat other members respectfully
Protect the privacy of other participants
Avoid harassment, discrimination, threats, or abusive behavior
Avoid unauthorized solicitation, spam, or promotion
Refrain from sharing another member’s recordings, messages, personal information, or work without permission
Respect copyrights and other intellectual-property rights
Avoid disrupting sessions or community activities
We may remove content, restrict participation, suspend access, or terminate membership when conduct materially harms the community, violates these Terms, infringes another person’s rights, or interferes with the program.
You are responsible for protecting your login credentials and for activity conducted through your account.
Notify us promptly if you believe your account has been accessed without authorization. We may suspend access when reasonably necessary to protect an account, participant, program, or system.
Our websites and services may use or link to third-party platforms for hosting, email, scheduling, payments, video meetings, community access, analytics, or other business functions.
We do not control and are not responsible for the availability, content, security, or independent practices of third-party services. Your use of those platforms may also be governed by their terms and privacy policies.
We work to keep our websites and services functioning, but we do not guarantee uninterrupted or error-free operation.
We may modify, suspend, replace, or discontinue website features, content, schedules, or delivery platforms when reasonably necessary. When a material change affects a paid commitment, we will make a reasonable effort to provide an appropriate alternative.
Testimonials and examples describe individual experiences and are not promises that every participant will achieve the same outcome.
Your results depend substantially on your own participation, preparation, practice, consistency, prior experience, physical circumstances, and implementation.
To the fullest extent permitted by applicable law, Walter White Music and Foundation First Brass Academy will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of—or inability to use—our websites, materials, products, programs, or third-party platforms.
To the fullest extent permitted by law, our total liability concerning a paid product or service will not exceed the amount you paid us for the specific product or service giving rise to the claim.
Nothing in these Terms excludes liability that cannot legally be excluded.
You may not:
Use our websites or services for unlawful or fraudulent purposes
Attempt unauthorized access to accounts, systems, or protected content
Introduce malware or disrupt website or platform operations
Impersonate another person or misrepresent your identity
Infringe intellectual-property, privacy, publicity, or other legal rights
Scrape, copy, or systematically extract protected content
Use our materials to mislead others about an affiliation, endorsement, or certification
You are welcome to provide honest feedback and reviews. Nothing in these Terms is intended to prohibit or penalize a truthful consumer review. Federal law restricts standardized contract provisions that punish customers for honest reviews.
We may suspend or terminate access when you materially breach these Terms, fail to make required payments, misuse protected materials, harm other participants, or create a legitimate security or legal risk.
Termination does not eliminate payment obligations already incurred or provisions that reasonably survive termination, including intellectual-property protections, confidentiality obligations, limitations of liability, and dispute provisions.
These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles.
Before filing a formal claim, both parties agree to make a good-faith effort to resolve the matter informally by written communication.
I recommend not adding mandatory arbitration or a class-action waiver yet unless a Michigan attorney drafts or approves those provisions.
We may update these Terms periodically. The current version will be posted on this page with a revised effective date.
Material changes will apply prospectively unless otherwise required by law.
